"We" and "Us" means Kays of Scotland. "You" and “”your” means the person buying the goods from us. By using this web site, you agree to the following terms and conditions of use ("terms of use"). If you do not accept any of them, you should not place an order from this web site. Kays of Scotland reserves the right to change these terms of use from time to time.

GENERAL

All orders are accepted by Kays of Scotland are subject to these terms and conditions of sale, which supersede any previous terms and conditions. All descriptions and illustrations contained in this website are intended to be as close as reasonably possible, specifications may vary slightly. We reserve the right to change the specification from time to time, so long as the alteration is minor or an improvement and to reflect any alterations within the content of our web site e.g. product photographs, descriptions etc.

SALE OF GOODS

When your order is accepted, you agree to buy and we agree to sell to you the goods specified in the order at the price specified, subject to the Terms and Conditions set out here. We reserve the right to reject an order if there is any doubt as to its authenticity.

PAYMENT & CREDIT CARD SECURITY

Payment is by cheque or credit card basis with order by web site (credit card) or post (cheque). Cheques are subject to clearance before delivery. We reserve the right to charge bank charges on cheques which are represented. We reserve the right to refuse any credit card transactions. Your payments will be made to Kays of Scotland Ltd which will show on your Credit Card Statement. Credit Card details are taken via our secure server and are encrypted at point of entry. All on line payments are processed through World Pay and your card details are not handled by any member of staff at Kays of Scotland. Credit Card payment is taken at the time your order is processed.

REFUNDS POLICY

The Company offers a full refund on all goods that are returned by the Purchaser within 14 days of receipt. The cost of returning goods to the Company for refund is the responsibility of the Purchaser. We do not offer refunds on items that have been personalised unless a mistake has been made by the Company.

PRICES

All prices are inclusive of Vat @ 17.5% where applicable. If you are eliglible to reclaim this sales tax, the company can supply a VAT receipt on request. All prices exclude delivery charges. Non UK purchasers may be liable to local taxes on importation which will be your responsibility.

PERSONALIZATION (CUSTOMISATION)

Kays of Scotland supply some personalized gifts, and as such we agree to use reasonable skill and care in ensuring details are correct and as instructed. You must take as much care as possible in giving us your personalisation instructions. We cannot accept liability for incorrectly personalised items if your instructions were not reasonably clear. We may refuse to personalise items if we think that the personalisation is offensive or illegal. You agree to indemnify us against any claims or costs we may incur because your instructions cause us to break the law or rights of anyone.

AMENDMENTS TO PERSONALIZATIONS

If you ask us to alter your personalisation after the order has been received, we will make our best efforts to do so, however as we are committed to fulfilling orders quickly and efficiently this cannot be guaranteed and depends on the stage of production e.g. printing, binding etc. Changes, if possible, may result in an increased cost, which we promise to advise you of before going ahead with any changes in personalisation on your behalf. If you do wish to make any changes please call our customer service representatives on +44 (0) 1290 550256 for further advice.

ORDERING

Under the Distance Selling Regulations, European Union residents have a right to cancel an order for any item purchased on this web site within seven days of receipt, without giving a reason, and to receive a full refund. However unless the parties have agreed otherwise, the cooling off period and the right to cancel do not apply to contracts for goods made to the consumer's specifications or clearly personalised.

If, after you have placed an order, you wish to cancel it, we may consider doing so (although this at our discretion) but this may be subject to you paying us a handling charge. Unfortunately, we cannot accept cancellations after work has commenced on the personalisation, neither can personalised items be returned for a full refund, (as they have no resale value), if you have any doubts at all about the quality or suitability of a personalised item, we advise that you do not place the order without contacting our office first.

DELIVERY

Gifts are posted within one working days from order, subject to availability are sent recorded delivery and will require a signature. If for any reason the order is delayed we will inform you.You will become responsible for the goods as soon as we have delivered them to you, we shall be liable for damage or shortfall up to the point of delivery to you, provided that the damage or shortfall is notified to us or to the carrier within a reasonable time scale.

U.K Deliveries

Free delivery to anywhere in the U.K. Delivery may take between 2-4 days depending on location.

International deliveries - Free Standard delivery

This method is through using sea freight.

If the goods have not been delivered within 4-6 weeks, you must notify us or the carrier. If you require a quicker method of transportation we offer airmail service which will take between 3 – 6 working days depending on location. This service will cost you an additional £4 per item.

Kays of Scotland will not be held responsible for delays in the delivery caused by any other third party. The Customer shall inspect the goods within 7 days after their receipt. (This does not however affect the customer's statutory rights). Inspect any received package thoroughly before accepting/signing for it. If the package appears to have suffered shipping damage, keep the original shipping carton, promptly contact the shipping company for a damage inspection report and request that the shipping company return the merchandise. Under these circumstances, do not return the merchandise yourself. Gifts are returned at the sender's expense, a refund of shipping costs will be made only if the return is a result of our error or if the goods supplied are shown to be faulty.

We do not accept any responsibility for any web site not under our control which may be linked to this site. It is your responsibility to check all materials for possible viruses before downloading from this site for any purpose.

APPLICABLE LAW

These terms of use shall be governed by and construed exclusively in accordance with Scottish law. Any dispute arising under these terms of use shall be subject to the exclusive jurisdiction of the Scottish courts and, by using this web site, you hereby submit to and waive any objections to, the jurisdiction of such courts.

COMPLAINTS

Complaints will be dealt with speedily, fairly and effectively and all information exchanged will be confidential. We guarantee to respond to all complaints within five working days and to notify you as to the likely timescale and progress of the solution.
